Chapter 9 - THE FIRST HEARING

The family courtroom was smaller than Grace expected.
That made everything worse.
There was nowhere to hide from Ethan's expression.
There was nowhere to hide from Vanessa's red-soled heels beneath counsel table.
There was nowhere to hide from the judge when the allegations were read aloud.
Grace sat beside Maya with Sophie asleep in a carrier near her feet.
Luka sat in the back row.
He wore a black suit without a tie.
His tattoos drew glances from almost everyone who entered.
Ethan's attorney used them immediately.
"Your Honor, Mrs. Cole has placed herself and the infant in the custody of a private security contractor with a documented history of violence."
Maya stood.
"Mr. Moretti is not a party to this case."
"He signed his name on hospital birth paperwork as the child's father."
A murmur moved through the room.
The judge looked at Grace.
"Is that true?"
Maya answered carefully.
"He signed a preliminary hospital worksheet to trigger an administrative hold after evidence emerged that the child's records were being manipulated."
"Was it legally valid?"
"No."
"Was it represented as legally valid?"
"No."
The judge turned to Ethan's attorney.
"Move on."
The attorney did.
He displayed Grace's forged text messages.
He displayed a photograph of Grace outside Vanessa's hotel room three weeks earlier.
He displayed a grainy clip that appeared to show Grace shoving Vanessa.
Grace leaned toward Maya.
"I never shoved her."
"I know."
"That video is cut."
Maya nodded.
"We will get there."
Ethan took the stand.
His voice was soft.
He looked exhausted.
He looked sympathetic.
Grace almost admired the performance.
"I love my wife."
Grace felt sick.
"I also love my daughter."
He paused.
"But Grace has not been herself for months."
Maya wrote something on a legal pad.
Ethan continued.
"She became suspicious."
"She accused coworkers of affairs."
"She threatened to leave."
"She said things that scared me."
Maya stood for cross-examination.
"Mr. Cole, when was your daughter born?"
"Tuesday morning."
"What time?"
Ethan hesitated.
"Around six-thirty."
Grace closed her eyes.
He did not know.
Maya did.
"Six forty-one."
She approached the witness stand.
"Your emergency petition was electronically filed at six twelve."
"Correct?"
"My lawyer prepared it."
"That was not my question."
"Yes."
"Your sworn affidavit states that Mrs. Cole exhibited dangerous postpartum behavior after the child was born."
"Correct?"
Ethan shifted.
"The language was meant to cover ongoing conduct."
"Conduct that occurred twenty-nine minutes in the future?"
The judge looked over her glasses.
Ethan's attorney objected.
"Sustained as argumentative."
Maya changed direction.
"Did you authorize a nurse to sedate your wife?"
"I authorized medically necessary care."
"Did you speak to Nurse Linda Price?"
"I don't remember."
"Did you speak to Peter Lang?"
"Not that morning."
Maya held up a phone record.
"Your phone called Mr. Lang at 5:58 a.m."
Ethan's face changed.
Only slightly.
Grace saw it.
"I speak to Peter often."
"About your wife's psychiatric chart?"
"No."
"About the Bennett Successor Trust?"
Ethan's attorney stood.
"Objection."
The judge leaned forward.
"Overruled."
Ethan looked at Maya.
"The trust affects the company where I work."
"It also gives temporary control to the child's legal father if Mrs. Cole is declared unfit within thirty days."
"Correct?"
Ethan's attorney objected again.
The judge overruled again.
Ethan's jaw tightened.
"That is one provision."
"So you had a financial interest in your wife being declared unfit."
"I had an interest in my child's safety."
Maya returned to counsel table.
"No further questions."
Grace thought they had won.
Then Ethan's attorney called Dr. Warren.
Grace relaxed when the psychiatrist confirmed there was no basis for involuntary commitment.
Then he added something no one expected.
"However, the patient's toxicology panel showed a sedative in her system before I evaluated her."
Maya stood.
"What sedative?"
Dr. Warren named it.
It was the same medication Linda Price had tried to inject later.
Grace stared at him.
"I never took that."
The judge called a recess.
During the break, Maya found the anesthesiology record.
The drug had been entered as part of Grace's labor medication at 5:31 a.m.
The anesthesiologist denied ordering it.
Somebody had begun drugging Grace before Sophie was born.
The hearing resumed.
The judge refused Ethan's request for sole custody.
Grace nearly cried with relief.
Then the judge ordered temporary supervised visitation for Ethan, a forensic review of Grace's medical records, and immediate independent DNA testing due to the disputed paternity claim.
"Until those results are returned, neither parent may remove the child from the county."
Grace nodded.
It was not perfect.
It was survival.
Before adjourning, the judge addressed Ethan directly.
"Mr. Cole, I am troubled by the timing of your filing."
Ethan kept his face neutral.
"I understand, Your Honor."
"I am also troubled by evidence that Mrs. Cole's medical record was altered."
"I had nothing to do with that."
"I did not ask you a question."
Ethan stopped talking.
Grace almost smiled.
The judge continued.
"Until this court understands how those entries were created, neither party is to rely on them in public statements as established medical fact."
Vanessa leaned toward Ethan's attorney.
The judge noticed.
"That includes statements made through counsel, publicists, associates, or unnamed sources."
Vanessa sat back.
Grace felt a small pulse of satisfaction.
Then the judge turned to her.
"Mrs. Cole, the same rule applies to you."
"Yes, Your Honor."
"This child is not a corporate asset."
Grace's eyes burned.
"I know."
"Make sure everyone around you does too."
Grace looked toward the back row.
Luka met her eyes.
He gave one small nod.
The hearing ended.
In the hallway, Ethan approached Grace before security could separate them.
"You think this went well?"
Grace held Sophie closer.
"Better than your petition did."
Ethan lowered his voice.
"You are embarrassing yourself."
The old phrase almost worked.
For years, Ethan had used embarrassment to control her.
Do not embarrass me at dinner.
Do not embarrass us in front of the board.
Do not embarrass yourself by getting emotional.
Grace looked at him now and felt the mechanism fail.
"You know what is embarrassing?"
"Not knowing the time your daughter was born."
Ethan's face tightened.
"Do not use her against me."
Grace stared at him.
"That sentence would be funny if it were not disgusting."
Vanessa approached.
"Ethan, leave it."
Grace looked at her cousin without yet knowing she was her cousin.
Something in Vanessa's expression was different after the hearing.
Not remorse.
Fear.
Grace filed the observation away.
She had begun to understand that fear often pointed toward the person with the most power in a conspiracy.
Ethan was angry.
Vanessa was afraid.
Those were not the same thing.
The reporters waiting beyond the courthouse doors made it impossible to think further.
Outside the courtroom, reporters had already gathered.
Someone had leaked the story.
Questions exploded around Grace.
"Did you cheat on your husband?"
"Is Luka Moretti the father?"
"Are you mentally fit to raise your child?"
Luka pushed through the crowd and placed himself between Grace and the cameras.
He did not touch her.
He simply created space.
Then a lab courier approached Maya.
"Ms. Torres?"
"Preliminary chain-of-custody issue."
He handed her a sealed notice.
Maya opened it.
Her face changed.
"What?"
Grace asked.
Maya looked at her.
"The sample labeled Ethan Cole does not match the hospital sample previously stored under his name."
Ethan stopped several feet away.

For the first time, she looked frightened.
